As of late 2024, Timor-Leste is still in the process of establishing a comprehensive formal system for intellectual property (IP) rights. While a legal framework is developing, the current system relies on a mix of domestic legislation, international treaties, and informal practices like “Cautionary Notices”.

General IP situation in Timor-Leste

  • Absence of full legislation: Unlike many countries with fully established IP registries, Timor-Leste does not yet have a formal IP office or a national database for patents and trademarks.
  • Constitutional recognition: The country’s Constitution recognizes the need to protect literary, scientific, and artistic works in Article 60. This provides a legal basis for IP, but detailed legislation is still being developed.
  • Industrial Property Institute: The Timor-Leste Industrial Property Institute (IPITL, I.P.) has been established. Its mission is to promote and protect industrial property and to collaborate with international organizations.

Main IP Authority

The Directorate of Intellectual Property (DPI) under the Ministry of Tourism, Commerce and Industry (MTCI) is responsible for the administration and registration of intellectual property rights in Timor-Leste.
